This agreement is made and entered into this ___ day of _____________ by and between __________________________________(Seller),
and____________________________________ (Buyer), for the purpose of setting forth the terms and conditions of purchase by the Buyer of a purebred Yorkshire Terrier from the litter whelped on ____________________________________ out of _
Sire name:______________________________ #: _________
and Dam Name: _____________________________#: __________
For $__________, the seller agrees to sell and the buyer agrees to purchase a female_____, male ____ companion puppy from the litter described above subject to the following terms. I do NOT accept checks, cash or Paypal only please.
1. Seller warrants that the above described puppy/dog is a purebred Yorkshire Terrier,
registerable with the AKC and/or CKC and that registration papers
have ____have not_______ been provided to the Buyer as of the date of the completed purchase, together with a true copy of its pedigree.
2. Seller warrants that the above-described puppy/dog is in good health at the time Buyer assumes ownership. Buyer agrees to have the puppy examined by a licensed Veterinarian with two (2) days (not including weekends and holidays) of receipt of puppy/dog.
If, as a result of the examination, the Veterinarian determines that the puppy/dog is not in good health then the Buyer shall elect to keep the puppy/dog or return the puppy/dog to the Seller for a refund. If the buyer elects to return the puppy, Buyer shall, within 72 hours after the date of the signing of this contract, send to Seller by certified mail a written Veterinarian's certificate stating that the puppy/dog was in ill health when examined. Upon receipt by Seller of said certificate, Buyer shall be obligated to return the puppy/dog to Sellers at Buyers expense. Upon receipt of the puppy/dog, the Seller shall be obligated to refund all monies received from Buyer toward the purchase price of the puppy/dog, and further performance under this contract shall be null and void.
3. Seller warrants that the puppy/dog sold is completely free of genetic diseases, such as liver shunts, etc. If said puppy/dog develops a genetic disease within 12 months from date of birth, the Buyer may return the dog to Seller and will receive a replacement puppy/dog of like quality from the next available litter, OR may keep the dog if he/she chooses and will receive 50% of the original purchase price. Due to the possibility of physical injury as the cause, luxating patellas are NOT covered under this guarantee.
If Buyer chooses a replacement puppy/dog, Buyer and Seller shall make prompt arrangements within 10 days of receipt of certified letter and Veterinarian certification for return of the puppy/dog sold herein to Sellers place of business. Buyer shall be responsible for taking good and reasonable care of the puppy/dog until Seller receives it. Costs and related expenses of returning the puppy/dog to Seller shall be the obligation of the Buyer. Seller is NOT responsible for other illnesses such as kennel cough, giardia, colds, etc. that you puppy may have or get. These can be easy treated through vet care, and are not reasons to panic.
4. Puppies will go home within the 10 to 12 week age range. If a deposit is placed on a puppy, you will receive weekly updates and pictures of your pick of the litter.
5. Ownership of the puppy/dog will be transferred to the Buyer for the sale price of $________ to be paid as follows: deposit in the amount of 1/4 the purchase price on execution of the Agreement with the balance of $_________ to be paid on or before the puppy/dog leaves the Sellers premises. If the balance is not paid by the time he/she is ready to go to their new home, the potential buyer has 2 weeks to made a decision. After that point, this Agreement shall be cancelled and the Buyer forfeits the deposit given hereunder.
6. The Seller cannot guarantee any of the following: personality, full grown weight, hair color, hair texture, conformation, dropping of testicles, etc. The Seller also does NOT guarantee against the following: hypoglycemia, cherry eye, eye entropion/extropion, heart murmurs, loose knees or hips, dentition (over or under bite), hernias, fleas, worms, coccidian, hot spots, giardia, dermatitis, or ear mites.
7. The Seller has determined that the puppy/dog is of "pet quality" and is NOT suitable for breeding. In such case, Seller shall provide Buyer either with Limited Registration Certificate OR a Spay/Neuter contract (and the full AKC papers will be withheld by the Seller until proof is shown that the puppy has been spayed/neutered around 6-8 months of age). If the buyer chooses not to have his/her puppy altered, by the contract, he/she will not receive the papers on his/her puppy.
8. Seller agrees to distribute registration papers to buyer upon receipt of evidence from a licensed Veterinarian that the puppy/dog has been spayed/neutered. The evidence must either be a phone call to a reputable veterinarian who did the surgery, or a signed, dated, note from the veterinarian stating that the dog/puppy was altered. I would also prefer to see the puppy myself, but I realize that’s not always doable. I will HOLD the puppy's registration papers until he/she is spayed or neutered. Upon proof they will be either mailed or handed to you in person.
9. Buyer agrees that he/she is not acting as an agent in the purchase or this puppy/dog and that Buyer will not sell this puppy/dog or its progeny to any agent, pet store or guard dog business.
